Understanding Expunction in Texas

Texas state law provides a process known as expungement—also called expunction—through which you can have a misdemeanor charge removed from your criminal record. For most misdemeanor offenses and virtually all felony offenses, expungement is not an option if you were convicted or received deferred adjudication. However, you may be able to have your record expunged if you were convicted on a Class C misdemeanor charge.

Common Class C misdemeanors in Texas include the following:

  • Theft under $50 (under $100 if the offense occurred after September 1, 2015);
  • Public intoxication;
  • Disorderly conduct;
  • Driving without a valid license;
  • Simple assault;
  • Minor in possession of alcohol; and
  • Low-level drug possession.

If you pleaded guilty or no contest and received deferred adjudication, also known as court-ordered community supervision, you may apply for expungement once you have completed your deferred adjudication, unless you are under the age of 21. In that case, you will need to wait until you turn 21 to begin the process. You must also not have a felony conviction on your record for five years leading up to your misdemeanor arrest.
