Almost every day, news reports are full of stories about large-scale drug busts and other drug-related arrests. If you have ever been arrested for a drug crime—even if you were never convicted—your arrest has probably created problems for you at some point. You may have had trouble getting a good job, finding a decent place to live, or even securing auto financing. Fortunately, such problems do not need to last forever. We are Clear My Record San Antonio, and we are equipped to help you get the fresh start you deserve through expungement or nondisclosure.

Expunging Drug Arrests in San Antonio

Expungement—also called expunction—means that all records of your arrest and prosecution are destroyed and no longer visible on criminal background checks. To be eligible for an expungement, you must meet certain criteria. You may qualify to have your drug arrest expunged from your criminal history if:

  • You were arrested but never charged;
  • You were arrested and charged, but the charges were dismissed;
  • You were arrested and charged, but were acquitted at trial; or
  • You were arrested, charged, and convicted, but the conviction was later overturned or pardoned.

Expungement might also be possible if you were charged with a Class C misdemeanor—for example,, simple possession of drug paraphernalia—and you received deferred adjudication.

Texas Lawyer for Nondisclosure of Drug Crimes

If your arrest on drug charges was prosecuted as more than a Class C misdemeanor and you were found guilty, you will not qualify for expungement. There may be other options, however, if you received deferred adjudication. In most cases of deferred adjudication, you can file a petition requesting an Order of Nondisclosure. This Order does not remove your arrest record completely, but instead limits who is permitted to know about it. In practice, this also means that most prospective employers, landlords, and lenders do not need to know about your arrest, and they will not find it in a background check.
