  • You were arrested on suspicion of DUI, but no charges were ever filed;
  • You were charged with DUI, but the charges were eventually dropped; or
  • You were convicted on DUI charges, and your conviction was later overturned or pardoned.

Expungement may also be possible if you accepted a plea deal that resulted in you receiving deferred adjudication for a Class C misdemeanor—obstructing a highway or reckless driving, for example—rather than full DUI charges.

DUIs and Orders of Nondisclosure

Driving under the influence and related offenses are the only misdemeanors that are not eligible for deferred adjudication under current Texas law. That means a conviction of DUI lasts for the rest of your life. No deferred adjudication also means that there is no way to apply for Order of Nondisclosure related to a DUI charge. If your plea deal resulted in deferred adjudication for an offense other than a Class C misdemeanor, a nondisclosure order could still be an option for you.
